Foreclosure for Renters
Residential renters in a residential or commercial property facing foreclosure might be secured by NJ's Anti-Eviction statute, N.J.S.A. 2A:18 -61.1 to 61.12. Legitimate residential occupants have rights to remain on the residential or commercial property regardless of a foreclosure.
Frequently, because lending institutions do not know tenants' names, the foreclosure grievance will call "John Doe, Tenants No. 1 to 10." If a lending institution is uninformed that the residential or commercial property is rented, an occupant may first be informed about the foreclosure when the lending institution has a writ of ownership. See the notice to domestic renters of rights during a foreclosure.
